DUI Conviction Rates

​​In the 2020 Regular Legislative Session, the WV Legislature passed SB 130 which changed the way driver license revocations for drug and alcohol impaired drivers were processed in West Virginia. Previously, West Virginia was an “administrative license revocation” (ALR) state which authorized the DMV to take action independent of the criminal justice system when a person drove in West Virginia under the influence of alcohol or drugs. The legislature sought to avoid duplication of effort and to expedite the license revocation process. West Virginia became the first state to eliminate its ALR process which had previously resulted in 90% of impaired drivers receiving a license revocation, safety and treatment opportunities, and ignition interlock restrictions within 30 days of the DUI arrest. The results of SB 130 have been much different. The map provides a county by county look at how DUI arrests have been processed since July 1, 2020 to December 30, 2020 for all DUI arrest and conviction information provided to the Division of Motor Vehicles as of January 11, 2021. Statewide, 22% of alleged impaired drivers have received a license revocation, safety and treatment opportunities and ignition interlock restrictions within the first six months of the new legislation. Counties with a conviction rate for impaired driving offenses in excess of 75% or greater are denoted in green. Counties with a conviction rate of 50% to 74% are denoted in yellow. Counties with a conviction rate of 0% to 49% are denoted in red. Counties with no reported DUI arrests are denoted as gray. The map will be updated periodically as new information is made available to the Division.​
