Oil and Gas Roads Policy and Permitting

As per the Updated Oil and Gas Policy, permits (MM-109) are require for any work within the Division of Highways's right of way. All permits (MM-109) are applied for online on the Permit Portal Main Page. Local Contacts under each District from the Districts page of this website.


Permit Requirements (MM-109)

Pre-Approval Compliance

Applicant will be required to have an appropriate bond and Road Maintenance Agreement in place before receiving an approved permit.

Financial BondApplicants must secure an appropriate SM-6 Bond to cover potential road damages.
Maintenance AgreementA formal Road Maintenance Agreement must be active between the operator and the WVDOH.
