Sealed bids covering the disinterment and reinterment of the remains of approximately (36) THIRTY-SIX decedents from the Milam\Gross and Cook Cemeteries, situate within the right of way limits of the West Virginia Department of Transportation, Division of Highways' Project X341-121-0.78 00, HHP-0052(256)D, Slab Fork District, Raleigh County, West Virginia, to other locations as set forth in the contract proposal, will be received by the West Virginia Department of Transportation, Division of Highways, at its Central Right of Way office at the Capitol Complex, Building 5 Room A-618, 1900 Kanawha Boulevard East, Charleston, West Virginia, 25305-0430 until 1:00 PM on the 24th day of November, 2009.  The next business day at 11:00 AM said bids will be publicly opened and read at the West Virginia Department of Transportation, Division of Highways, Capitol Complex, Building 5, Room A-618, Charleston, West Virginia, 25305‑0430.  The grave sites within the aforesaid cemetery are shown upon said right of way plans of the West Virginia Department of Transportation, Division of Highways.

A Mandatory On-Site Pre-Bid Conference will be held at 10:00 a.m. on Wednesday, November 18, 2009, at the Existing Milam\Gross and Cook Cemeteries, with all potential bidders meeting at the end of the pavement of the Coalfields Expressway, WV Route 121, just south of the Slab Fork Exit.  Attendance is required at the pre-bid meeting by all bidders on this project to familiarize themselves with the cemetery site, the reinterment sites, the details and scope of work required, and other relevant information.  Failure to attend this pre-bid conference by any Bidder will result in their Bid being disqualified.    

Each proposal must be submitted on West Virginia Department of Transportation, Division of Highways approved forms and must conform with Department plans and specifications for said work and contract provisions, copies of which are available at said Right of Way office or by calling (304) 558-9338. Performance bond will be required of successful bidder.

The work to be performed is part of a Federal-aid construction contract including, but not limited to, equal opportunity provisions, predetermined minimum wage rates determined by the United States Secretary of Labor and the West Virginia Department of Commerce, Labor and Environmental Resources, Division of Labor.  The West Virginia Department of Transportation, Division of Highways, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252) and the regulations of the West Virginia Department of Commerce, Labor and Environmental Resources, Division of Commerce (15 C.F.R.; part 8), issued pursuant to such act, hereby notifies all bidders that it will affirmatively insure that in any contract entered pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation, and will not be discriminated against on the grounds of race, religion, color, sex, national origin or disability in consideration for an award.

Proposal guaranty of $500.00 or 5% of total bid, whichever is greater, is required to be submitted with each bid.  Surety bond, Cashier's or Certified Check only will be submitted with each bid.  Surety bond, Cashier's or Certified Check only will be acceptable.

The right is reserved to reject any or all proposals.
